Для приобретения недвижимости в США через банк необходимо внести первоначальный взнос - от 20% до 30% от стоимости недвижимости, остальное финансирует банк. Заем можно получить на срок до 30 лет.

Но всегда есть способ сэкономить при покупке недвижимости в США. Речь, прежде всего, идет об инвестировании в недвижимость на начальной стадии строительства. Такое вложение средств поможет сэкономить 20% от стоимости недвижимости. А если учесть, что через год квартира или иная недвижимость станет дороже еще на 20%, то можно понять насколько такие инвестиции являются выгодными. Вполне понятно, что наличие недвижимости в США будет свидетельствовать о вашем достатке и успешности. Причем размещение недвижимости в разных штатах несет различный оттенок.
В Штатах ценится любая недвижимость, поэтому не стоит относиться пренебрежительно к вторичному рынку. Но в любом случае довольно сложно самостоятельно покупать недвижимость в США. Нужно подобрать объект и проанализировать его. Потом проанализировать договор покупки-продажи, разобраться со страхованием и налогообложением. Всё это довольно сложно для человека, не знакомого с многогранным Американским законодательством. Дело в том, что в одном штате действуют одни законы при покупке недвижимости, а в другом штате совсем другие. Лучше заранее позаботиться обо всех нюансах сделки, а лучше всего это сделать при помощи квалифицированного специалиста. Ведь если вы не уплатите какой-то налог даже случайно, вы автоматически станете злостным преступником. Помните, что ваши ошибки при уплате налогов могут привести к самым плачевным последствиям, вплоть до тюремного заключения с конфискацией имущества. Отягощается всё тем, что покупая недвижимость в США в разных штатах необходимо уплачивать разные налоги.
Типичной для США недвижимостью являются дома и квартиры. Причем она является типичной как для покупки, так и для аренды. Разумеется, необходимо обращать внимания и на офисные здания при открытии собственного бизнеса в Штатах. Лояльная система кредитования поможет вам взять кредит на понравившуюся недвижимость под выгодный процент и на длительный срок. Стандартный процент для кредитования находится в рамках 5-6%, и это при том, что срок кредита может составлять 30 лет. Как правило, кредит берут иностранцы для приобретения недвижимости на побережье. Здесь уже можно встретить роскошные апартаменты и огромные виллы. В таких местах, как правило, имеются целые архитектурные комплексы, в которых каждый найдет себе что-то по душе. Если же говорить о штатах, то особой популярностью недвижимость в США среди прибрежных штатов пользуется Майями.
Как известно, в последнее время цены на недвижимость в США сильно упали, но все мы знаем, что этот процесс не будет длиться долго и со временем цены вернутся к былому уровню и продолжат расти. Благодаря падению цен можно выгодно вложить свои средства и получить через пару лет весьма приличную прибыль. Даже если у вас сейчас нет денег на роскошный особняк, то даже покупка обычной квартиры-студии поможет вам обогатиться. Хотя, как уже говорилось, система кредитования открыта для всех и может упростить вашу жизнь при выборе и покупке недвижимости.


Покупка недвижимости в США


Приобретение недвижимости иностранцами в США проходит под контролем специализированного агентства, называемого Title Company, от составления договора купли-продажи до завершения сделки – closing. Эта компания передает документы о праве собственности покупателю, а продавцу деньги за покупку. Покупатель становится полноправным владельцем недвижимости после полной оплаты сделки, дополнительных расходов, налогов, выплат по ипотеке (если есть).
Собственно дополнительные расходы укладываются в 2% от общей стоимости недвижимости и включают проверку объекта на юридическую чистоту, оплату услуг адвоката, и т. д.
После подбора необходимого объекта недвижимости, обсуждения сроков и формы оплаты составляется договор купли-продажи Real Estate Purchase contract. Покупатель выплачивает депозит 10 000$. Регистрация права собственности занимает около 60 дней. Если вы планируете воспользоваться дополнительным финансированием, следует подать в банк все необходимые документы. Необходимо также провести Physical Inspection, этим занимается профессионал, а услуга стоит 350$. После выдачи банком документа, подтверждающего согласие выдать покупателю ипотечный кредит, нужно застраховать недвижимость. Покупатель выплачивает оставшуюся сумму, а продавец передает ключи.
Завершение сделки называется closing statement и происходит в присутствии нотариуса. В тот же день сделка должна быть зарегистрирована в специальном районном отделе регистрации. право собственности подтверждается специальным документом – Title.
Владелец имеет право продать недвижимость, а также сдать ее в аренду, передать  по наследству.
Налога на покупку/продажу во Флориде нет. В целом же, налог на доход от продажи может составить от 8% до 15% в зависимости от суммы дохода.
Ежегодный налог на недвижимость составляет 2%, это приблизительная цифра, так как она отличается в разных округах. Кроме того, если Вы владелец недвижимости в жилом комплексе, предстоит выплачивать ежемесячные расходы по ее содержанию, включающие в себя также оплату за содержание комплекса.

Вид на жительство


Вид на жительство (green card) можно получить после 5 лет работы в стране, или женившись на гражданине США, либо через приобретение собственного бизнеса в США. Обладатели green card не обязаны становиться гражданами США – они могут и пожизненно оставаться в статусе постоянного жителя Америки.

Факт владения недвижимостью в США является лишь основанием для обращения за визой (ведь если нет основания, то вопрос даже и рассматривать не будут). Однако, в случае подачи заявления на green card по другим основаниям, приобретение дома может быть принято во внимание как фактор финансовой стабильности заявителя. Никакого юридического права на визу не возникает, однако, как правило, владельцы недвижимости получают мультивизу в США на 1-2 года. Но если человек вызовет какие-либо подозрения у консульской службы - визу не дадут.

Имеется специальная программа для иностранных инвесторов для получения вида на жительство в США. В этом случае необходимо инвестировать в американскую экономику от $500 тыс. до $1 млн. в зависимости от штата и города, а также предоставить работу не менее 10 гражданам США на протяжении не менее 2-лет, в течение которых идёт оформление green card.

Если покупатель имеет свою компанию в Украине, где работает не менее 15-20 человек, он может претендовать на бизнес визу, которая открывается для топ-менеджеров международного класса и может быть конвертирована в green card через год при условии создания рабочих мест и реального функционирования бизнеса. Вид бизнеса определяет количество работников.

В штате Флорида есть две уникальные государственные программы. Согласно первой иностранцу необходимо инвестировать $500 тыс. на срок 5 лет с гарантированным возвратом, и тогда он получает green card. Но конкретный уровень доходности никто не гарантирует (доходы могут быть, а могут и не быть - на эти средства строятся преимущественно объекты социального назначения). Согласно второй программе для получения green card необходимо инвестировать $1 млн. в два роскошных апартамента (2 и 3 спальные) в кондо-отеле во Флориде (уже построенном и работающем с определенной нормой прибыли). Инвестор получает прибыль от сдачи апартаментов в аренду. Но количество квот весьма ограничено.

Пребывание в стране не должно превышать 6 месяцев. Исключением может быть приобретение коммерческой недвижимости, которой иностранец должен управлять, т.е. сделать ее объектом бизнеса. Если средства ограничены, до получению вида на жительство можно снимать дом за $1000/месяц а после получения green card коммерческую недвижимость можно продать и средства использовать для приобретения дома и бизнеса.

Одним из способов более быстрого получения вида на жительство в США является владение собственным бизнесом. Это можно сделать, купив его или открыв. Любая компания может стать спонсором для получения деловой визы «L-1» или green card. Рабочий статус «L-1» сотрудника или владельца компании будет предоставляться на срок от 1 до 7 лет, в этот период можно получить и green card. Для членов семьи может быть открыта виза «L-2» – то есть для сопровождающих (по ней можно жить, учиться, но не работать). Для того чтобы фирма могла помочь вам получить рабочий статус «L-1», она должна быть связана с другой иностранной компанией каким-либо образом. В данном случае такой связью будет претендент, если у него есть бизнес в другой стране. Для преодоления всех формальностей понадобится помощь квалифицированного юриста.

Как только формальности с открытием улажены, компания подает заявление на предоставление рабочего статуса «L-1» в офис миграционной службы США. После этого надо подать заявление на получение въездной визы «L-1» в консульство США. Заявление на предоставление вида на жительство для владельца, исполнительного директора или менеджера международной компании – самый быстрый путь к получению грин-карты. Такие лица как правило становятся постоянными жителями США до истечения трехгодичного срока действия статуса «2L-1». Процесс оформления грин-карты может занять до года.

Что касается самой компании, то наиболее выгодным профилем деятельности будет поиск и покупка участка земли для строительства дома. Для получение вида на жительство надо продемонстрировать, что компания функционирует: будет строить дом на выбранном участке земли. Если вносится только часть средств на строительство, а оставшуюся часть вносит банк, у претендента на получение вида на жительство начинается кредитная история на территории США. После постройки дома можно продать его самому себе, используя банковскую ссуду, и кредитная история пополнится еще одной записью. Таким образом, к тому моменту, когда можно будет получать вид на жительство, уже будет недвижимость в США, богатая кредитная история, действующий бизнес с нормальным оборотом. Все это сделает процесс получения вида на жительство гораздо более быстрым и легким.

Гражданство


Сам порядок получения гражданства включает три стадии: подачу заявления, прохождение интервью, клятву на верность США. Срок оформления зависит от количества заявителей, и в настоящее время в большинстве своем весь процесс занимает минимум один год. Для того чтобы получить право подачи заявления, необходимо прожить в стране минимум 5 лет в статусе постоянного жителя США. А так как весь процесс занимает много времени, можно подать заявление за 3 месяца до истечения этих 5 лет. Если green card была предоставлена на основании брака с гражданином США, то можно подавать заявление на гражданство через 3 года. В случае развода, раздельного проживания или смерти одного из супругов нужно ждать положенные 5 лет.

Если интервью прошло удачно, назначат дату церемонии дачи клятвы – вместе с другими заявителями. После клятвы заявитель становится полноценным гражданином США, получает свидетельство о гражданстве «Сертификат о натурализации» (Naturalization Certificate). Сразу после натурализации он может обратиться за паспортом США.

Некоторые люди не могут получить гражданство США в течение определенного периода или даже никогда. Лишаются права получения гражданства в течение определенного срока лица, которые в течение 5 лет (3 лет – для обладателей green card на основании брака с гражданином США) совершили правонарушения.

Как правило, лишение права на гражданство основано на осуждении за уголовное преступление. Особенно это относится к наркопреступлениям: почти все нарушения закона, имеющие отношение к наркотикам (включая употребление), лишают права на гражданство, за исключением единичного случая хранения максимум 30 граммов марихуаны. Иногда преступления, совершенные более 5 лет назад, также не позволят стать гражданином США. Некоторые тяжкие преступления, совершенные в любое время, могут навсегда лишить прав на гражданство (убийства, преступления с применением насилия, провоз и распространение наркотиков, нелегальная торговля оружием)

США будут благоприятствовать иностранным инвесторам в сфере недвижимости

В своем недавнем заявлении, размещенном на официальном сайте Белого дома, президент США Барак Обама рассказал о переменах, которые ожидают в ближайшее время рынок недвижимости для иностранных инвесторов. Об этом сообщает сайт  компании Lagret Real Estate
В общем и целом послание Обамы является приглашением «приехать и остаться». Это не очень популярный призыв в самих США, но эта политика позволит привлечь 5-11 миллионов новых мигрантов, которые будут нуждаться в жилье. Это позитивно отразится на рынке недвижимости. Для иностранных инвесторов повышенный запрос, растущая стоимость жилья и его аренды делают владение недвижимостью в США все более и более привлекательным.
В последнее время иностранные заемщики с трудом получали ипотечные кредиты в Америке, отмечает Обама. Недавно правительство США «оказало давление» на национальные банки и кредитные компании с призывом ослабить слишком строгие требования для заемщиков и ввести более низкие ставки по кредитам. Сегодня международные инвесторы в недвижимость уже могут воспользоваться ипотечными кредитами в банках США и таких компаниях, как Rental Home Financing, которые предоставляют иностранцам ипотечные кредиты на большую часть cуммы для аренды даже таких объектов недвижимости, как многоквартирные дома.  
Система налогообложения оффшорных фирм, задействованных в индустрии покупки недвижимости, также будет более лояльной, по словам президента США. А Индивидуальные пенсионные счета (IRA) позволяют накапливать средства на пенсию вложением денег в недвижимость, и при этом иметь отсрочку по налоговым платежам и даже возвраты «такс фри».
Барак Обама также обратил внимание на то, что в стране введены новые правила и системы контроля мошенничества в сфере ипотечных кредитов. Теперь возможные риски будут предотвращены, что сделает рынок более безопасным для инвесторов. Наиболее привлекательными в данный момент для иностранных инвесторов были обозначены такие города, как Нью Йорк, Чикаго и Майами.

США приостанавливает выдачу «инвесторских» виз EB-5 для жителей Континетального Китая.

Причиной тому – настоящий «бум» заявок на данный тип визы со стороны жителей Континетального Китая. Данное решение правительства Америки не коснется представителей других стран, включая Россию.
Виза ЕВ-5 позволяет иностранным гражданам и их семьям получить грин-кард при условии инвестиций в размере 500 тыс. долл. в официально одобренные рабочие проекты на территории «целевых регионов занятости» США. Главной целью этих так называемых «Региональных центров» является создание новых рабочих мест – минимум 10 на каждого из инвесторов. Именно этот фактор тщательно проверяется правительством Америки. При соблюдении всех условий получатели ЕВ-5 имеют право постоянно проживать в США, сообщает британский портал The Move Channel
Данная программа пользуется огромной популярностью и привлекает серьезные капиталы в США. Среди новых одобренных инвестиционных проектов – роскошный отель Resorts World в Лас Вегасе, который был отмечен официальным сайтом EB5Select.com. Первая фаза строительства отеля на 3000 номеров принесет экономике страны 4 млрд. долл и предоставит иностранным инвесторам возможность создать 4500 рабочих мест и, конечно, получить желанные визы ЕВ-5.
30 cентября закончился фискальный год – период распределения виз ЕВ-5 (который длится с 1 октября по 30 сентября). Данные показали, что за прошедший период, впервые с момента введения ЕВ-5 в 1999-м, их выдача достигла ежегодного лимита в 10 тысяч. В данный момент рассмотрения ожидает еще около 12 тысяч заявок, несмотря на то, что лимит 2014 года уже исчерпан.
Сотрудники иммиграционной полиции обещают одобрить 75% заявок, однако предупреждают, что лимит по выдаче виз ЕВ-5 гражданам Континентального Китая исчерпан до конца календарного 2014 года и может быть заметно ограничен в 2015 году. Данные о новых квотах для жителей Китая поступят к июлю 2015 года.
По сравнению с 2007 годом количество заявок на американские визы ЕВ-5 выросло на 700%, и только в прошлом году доля распределения данного типа виз на граждан Китая составила 80%.
Китай стал очень активным участником рынков недвижимости по всему миру, вложив за 12 месяцев к марту 2014 года 22 млрд. долл. в недвижимость США – самую высокую сумму, потраченную когда-либо иностранными инвесторами на американском рынке недвижимости.

Question: Is the Montgomery County REA disclosure addendum
required in an estate sale situation where the seller is an heir of the
estate?

Answer: Yes. Although an estate seller is exempt by statute from
providing a Maryland Residential Property Disclosure and Disclaimer
Statement (GCAAR Form 912) under Section10-702 of the Real
Property Article of the Annotated Code of Maryland (transfer by
a fiduciary in the course of administration of a decedent's estate),
the disclosures and representations contained in the Government
Regulations, Easements and Assessments Disclosure and Addendum
(GCAAR FORM 900) apply to all sellers and thus are required in
Montgomery County sales.

Question: In the Home Inspection Contingency, if a Buyer requests
a closing cost credit in lieu of repair, can the Seller under Paragraph
2.A.c. cancel the contract on the 3rd day following the delivery of
the request for the closing cost credit unless the Buyer withdraws
the closing cost request?

Answer: No, If the parties have agreed to the terms of Paragraph 2 ("Home inspection contingency") of the Addendum of Clauses (GCAAR Form 1332) and Buyer has provided a copy of the report and Home Inspection Notice (GCAAR Form 1344) to Seller requesting a credit pursuant to subparagraph A, Seller may only either accept the offer contained in that Notice or make another offer. If Seller makes another offer and Buyer accepts it, the parties are bound. If Buyer counters Seller's offer, Seller may then at that time deliver notice that the contract will become void at 9 p.m. on the 3rd day following Delivery, unless the Buyer delivers to the Seller notice of acceptance of the last delivered offer. If Buyer does not accept Seller's prior offer within that time, the contract is then void.

Question: Is "hard money" financing considered cash or
conventional? Does an offer that is "not contingent on financing"
imply that the buyer will purchase the property even if the "hard
money" financing is not available?

Answer: Hard money financing is neither a conventional loan nor
cash. A "hard money" loan is typically issued by a private investor or company. Interest rates are typically higher than conventional loans because of the higher risk taken by the lender. Typically borrowers
use hard money loans when they would/could not qualify for a conventional loan. If there is no financing contingency, the buyer must purchase the property whether or not they qualify for a loan, hard
money or otherwise. I If they were unable to secure a loan, they would need to purchase the property with cash.

Fraud Warning On U.S. Investor Visa Program

The federal Immigrant Investor Program, known as the EB-5 visa program, which allows foreign nationals to obtain green cards in exchange for investing in U.S. job-creating ventures, has emerged as an increasingly popular alternative financing source for commercial real estate projects. However, as with any highly successful financing program, the fledgling program can be vulnerable to those with criminal intent.

The U.S. Securities and Exchange Commission (SEC) and U.S. Citizenship and Immigration Services (USCIS) this week jointly issued an alert cautioning investors about potential scams in the program, and supporters and skeptics alike are calling for tighter oversight of the program.

Along with issuing a warning to potential investors, the SEC stepped up its enforcement action by bringing fraud charges against Marco and Bebe Ramirez and three companies they own for fraudulently raising and then stealing funds from foreign investors under the guise of an investment opportunity to create jobs and a path to U.S. residency.

In the complaint unsealed this past Tuesday in U.S. District Court, Southern District of Texas, the Commission alleges that the Texas couple and their companies raised at least $5 million by making false promises that investor capital would be invested as part of the EB-5 program. The SEC alleges that instead of investing the money into job-creating enterprises, the couple diverted the funds to other undisclosed businesses, for their personal use, and, in at least one case, used investor funds to make Ponzi-like payments to an existing investor. According to the complaint, the couple started by targeting investors in Mexico, and more recently solicited investors in Egypt and Nigeria.

The federal court has granted the agency’s request to freeze the assets and accounts of the Ramirezes and their companies, USA Now LLC, USA Now Energy Capital Group LP, and Now Co. Loan Services, effectively halting their ability to raise or spend funds.

"Through their investment scheme, the Ramirezes abused a program intended to attract foreign capital to create U.S. jobs," said David R. Woodcock, director of the SEC’s Fort Worth Regional Office. Efforts to reach the couple of their representatives were unsuccessful.

The SEC and the USCIS, which regulates U.S. immigration policy, also Tuesday issued a joint investor alert about the program, with the SEC taking "emergency enforcement action" to stop allegedly fraudulent securities offerings made through EB-5.

In recent weeks, Congress and FINRA have also announced investigatory actions.

A group of congress members representing the Inland Empire in California, including Reps. Ken Calvert, R-Corona; Duncan Hunter, R-Alpine; Raul Ruiz, D-Palm Desert and Mark Takano, D-Riverside, sent a letter last month to House Judiciary Committee requesting a hearing to address EB-5 loopholes and abuses. Sen. Patrick J. Leahy, D-Vt., the program's original author, has requested amendments to streamline and improve the program.

Under U.S. securities law, any individual who receives a fee or commission for connecting a developer with investors must have a broker/dealers license. The number of unlicensed individual raising capital has drawn scrutiny from the SEC and FINRA (Financial Industry Regulatory Authority).

Business owners apply to USCIS to be designated as "regional centers" under EB-5 rules offering investment opportunities in "new commercial enterprises" that may involve securities offerings. A foreign investor in a project that meets the criteria is eligible to apply for conditional lawful permanent residency.

However, the foreign investors are not guaranteed a permanent visa, and the fact that a business is designated as a regional center by USCIS does not mean that any government agency has approved or expressed a view on the quality of the investments offered by the business, according to the alert.

In the enforcement action, the SEC alleged that the accused falsely promised investors a 5% return on their investment along with an opportunity to obtain an EB-5 visa and allegedly pitched investors even before USCIS had designated the business as a regional center.

The SEC also claim the defendants told investors their money would be held in escrow until USCIS approved the business but instead spent the funds for personal uses. The end result: investors did not obtain even conditional visas as a result of their investments, according to the SEC's complaint.

"Even though investors provided the Ramirezes with at least $5 million, none of them have ever received conditional visas, let alone green cards,” said David Peavler, associate director of the SEC’s Fort Worth Regional Office. "Instead, the Ramirezes opened a restaurant and purchased other assets for themselves and their employees.”

In another case, the SEC and USCIS halted an alleged $156 million investment fraud in which an individual and his companies used false and misleading information to solicit investors in the "world's first zero carbon emission Platinum LEED certified" hotel and conference center in Chicago.

According to the complaint, the individual falsely claimed that the business had secured all building permits and that the project was backed by several major hotel chains. The defendants promised investors that they would get back any administrative fees they paid for their investments if their EB-5 visa applications were denied.

However, the defendants allegedly spent more than 90% of the administrative fees, including some for personal use, before USCIS made a decision on the visa applications.

Despite the abuses, many developers around the country are successfully using EB-5 to raise huge amounts of capital in projects ranging from a few investors to pools of 100 or more investors.

Proponents have estimated that between $3 billion and $4 billion in direct foreign investment could be raised annually as new regional centers are formed to take advantage of the innovative visa program as a source of low-cost financing and promote it to foreign investors as a valuable investment tool, said Kate Kalmykov, a Greenberg Traurig, LLP attorney with extensive experience working on EB-5 immigrant investor matters.

Like many government programs, EB-5 attracts a few bad-faith actors that can harm the reputation of everyone, Kalmykov said.

“It's important to have government and industry oversight so the program continues and remains viable, and foreign investors feel confident investing in the United States," Kalmykov said. "EB-5 is a wonderful tool because it brings foreign investment into the U.S., it's a job creation program, and offers investors a streamlined way to immigrate to the U.S. without an employer or family sponsor."

One of the weaknesses of the program is what happens after the investment funds are raised, she said.

Currently, there's no follow up by USCIS to monitor how funds are being used. Setting regular milestones for capital raisers to report back to the immigration agency on the status of a project -- along with site visits by the agency to make sure the projects actually exist as proposed -- would likely increase compliance and serve as a tool to prevent fraud, Kalmykov said.

Just last year, policymakers turned to real estate investors to rescue the housing market. Scared the foreclosure crisis would drag on for years, the Federal Reserve supported renting out foreclosed homes as a market-based solution.

 Fannie Mae even experimented with selling big pools of them to buyers, although the plan never got past the pilot stage. In overwhelming numbers, investors raced to buy up foreclosed homes. Wall Street launched an industry based on buying and renting out homes in bulk, the demand pushing up home prices, in some areas even up to 20% in a year. Now, the inventory on foreclosed homes in those markets is almost gone, but investors keep buying and prices keep rising, making it harder for the average American to afford a house or qualify for a loan.
Interestingly enough, all-cash purchases made up an astounding 45% of all residential sales in August, up 30% over the same period last year. A large portion of those buyers are institutional investors, backed by Wall Street money, looking to convert the homes into rentals. An institutional investor is defined as someone who has purchased at least 10 properties in a 12-month period. The invasion of cash buyers poses a challenge for the ordinary person looking to purchase a home to actually live in. Cash buyers have the advantage of bypassing the mortgage financing process. It’s tough for the average American to compete against an investor unless they are very aggressive. Although frustrating, especially for first-time homebuyers, the upswing in home prices has been a much needed relief for borrowers who are underwater. Corelogic, a residential real estate company, recently determined that 2.5 million residential properties returned to positive equity in the second quarter of 2013.
The Commerce Department announced on Wednesday that the sales of new homes rose 7.9% in August, but still held at their lowest levels of the year. The data point is proof that the sharp and sudden rise in interest rates may be affecting the housing recovery.  Rates began to surge in May when the Federal Reserve hinted it would soon wrap up its bond-buying stimulus program, gradually increasing the record-low interest rates that provoked the housing boom. In a surprising move last week, the Fed shocked the markets by announcing it would delay reducing monthly bond purchases for now. 
Mortgage applications for the week ending September 20th rose 5.5%, including a 6.6% gain in purchase applications and a 4.9% gain in refinance applications. The 30-year fixed rate mortgage fell from 4.75% to 4.62%. The national median sales price in August was $175,000.

Right Sale Price For Seller Is Buyer's Call

Proper pricing is critical to a timely sale in any market. Yet, some home sellers today  still want to set their price in relation to what they have paid themselves or their neighbors have sold for or/and are asking now, sometimes ignoring current market conditions and the differences between homes.

When pricing a home - especially in today's housing market - we find it's helpful for sellers to understand what governs a buyer's decision to purchase.

Here is a quick look at how buyers view price:

  1. Monthly payments are usually more important to buyers than the sales price
  2. The "out of pocket" cash needed at settlement / closing is a big factor with buyers
  3. All buyers want to cash in on a good deal
  4. Buyers have often shopped the competition and know your home compares
  5. Buyers recognize value and shy away from overpriced homes
  6. Buyers do not want to pay for your mistakes ( for example, you paid too much when purchased, over-improving the home, poor-quality remodeling jobs, etc.)
  7. Buyers have no interest in how much money you need to realize from the sale to make your next move
  8. Buyers who work with a buyer's agent mean business. They are ready to negotiate and close the deal.

Rental Incomes Continue to Outpace Other Sources of Income


The economic recession in 2009 was painful to most people. However, as wages and salaries, proprietors’ income, and income from assets (e.g., stocks, etc.) contracted that year, aggregate rental income rose as many homeowners turned into renters.
With the economy growing again, the aggregate levels for all types of income has been rising. Rental income continues to outpace all other types of income and has been growing much faster than the inflation rate, creating high positive real returns.
However, the forces of supply and demand are starting to move towards a balance, with rental income growth now decelerating. On the supply side, more rental units appear to be coming into the market as investors are reportedly converting foreclosed properties into rentals. On the demand side, foreclosures have started to ease; although the magnitude of past due and foreclosed properties is still large, having dropped from a peak of 6.7 million to 4.8 million as of Q3 2012.
The outlook is for the demand for rental properties to continue to grow substantially if current mortgage standards remain excessively stringent. Although sound credit practices are essential, most REALTORS® believe that the current lending standards have become excessively tight, even for credit-worthy borrowers.
We get a number of comments from REALTORS® in our monthly REALTORS® Confidence Index survey concerning potential first-time homebuyers who lose bids to investors because of a strong rental market. If there is any consolation, the situation shows that the existing home sales market is strong and upbeat. In this type of situation the old phrase “Try, try again.” applies. Both mortgage money and homes are “out there,” but in this market persistence may be necessary.

How to Work the Room


How to Work the Room

Don’t be overwhelmed by a networking event full of strangers. This is your chance to create new business relationships. Here are some tips for breaking the ice and making the right connections.
Networking is all about meeting people, getting to know them, and potentially helping them. That’s it! When looking to “work the room,” always refer back to the definition (or at least my definition) of networking: learning about and helping others.
When your objective is to learn something about other people — whether it is culture, trends, upcoming conferences, product information, related articles and publications, or further contacts — you can’t lose. Helping someone in your target market is even better. Givers always gain and favors get returned, especially when the appropriate time comes to ask for them.
Remember, you’re looking to start a relationship. Choose your attitude before arriving at the meeting. Be genuine and have fun.

Get the Conversation Rolling

Repeat after me: It’s all about them. Confidently introduce yourself and ask a series of general questions to learn more about your contact’s work, goals, and initiatives. Here are some of my favorite questions to ask people to break the ice and, more important, to get to know them.
  • How did you learn of this meeting/event? (If it’s not obvious.)
  • Have you been here before? If yes, what brought you back?
  • Do you know a lot of people here? (If so, who?)
  • What kind of work do you do? (Again, if it’s not obvious.)
  • What company do you work for?
  • How long have you been at it?
  • Do you like what you do?
  • What is it about your work you like most? Least?
  • What are you looking for here?
  • Do you have a target market? (If so, great! If not, why not?)
  • How do you market your business?
  • What does a perfect prospect look like for you? Why?
  • What do you do for fun? (Sports, kids, vacation, hobbies, etc.)
  • What can I do to help you? (If I like them!)
That’s my short list in no particular order. I pick and choose as appropriate and as the conversation flows. Notice how all of these questions are focused on the other person? As in, it’s all about them.

The Next Step

If there’s a good connection or the person you meet is any kind of networker, they should be asking you the same questions right back. Remember, this will almost always begin as a superficial conversation. If there is a connection, then great! If not, that’s fine, too. After a few minutes, just say, “It was nice to meet you. Let me know if I can help you with anything at the event today; otherwise, good luck and hope to see you soon.” And that’s it. Never be rude, off-putting, or curt with anyone. Keep in mind that most people (even agents and brokers) are not very good at talking to strangers. (After all, didn’t mom tell you not to do that?)
If there is a good connection and the conversation is collaborative, briefly give an overview of what you do and how you help others (if you’re asked). For instance, I would say, “I’m a seminar leader, speaker, and consultant focused on helping real estate agents create more business through networking.” Hopefully they’ll ask questions that are as good as yours!
If there is a good connection and you think you can help one another, then exchange cards and commit to following up. Put some notes on the back of the business card you collected, shake hands, and say your good-byes. If you’re really brave, ask for an introduction to someone they know at the event that you want to know or offer to do the same. Believe it or not, all this should take place in no more than six to eight minutes (without looking at your watch).

Showing your home - tips for sellers

Selling a home while living in it is not easy – you want it to look its best when potential buyers come around. Still, with a plan in place, you can minimize the panic. Here is a checklist to help.

1. Tone it down! Turn off all electronics to cut down on noise.
2. Make it bright! Turn on all the lighting to illuminate every room. For daytime showings, open all window coverings.
3. Clear the clutter! Stash magazines, newspapers and mail in a basket or box you can easily slip under a bed or tuck quickly in a dresser drawer.
4. Stifle the odors! Be sure to remove the source of the odor, then open the window or door to let in some fresh air. If needed, place a small bowl of white vinegar or fresh coffee grounds in the area of unpleasant smells to absorb odors.
5. Round up the pets! Keep them safe, get them out of the way and make the buyers comfortable. Secure pets in their crates, outdoors or with you or a neighbor.
6. Check floors! Use a hand vacuum or damp cloth to remove debris or spots. Do a complete sweep-up if you have a time.
7. Make it comfortable! Turn down the air conditioner a degree or two to make it cool and inviting inside. Circulate air with fans on low if no AC
8. Kitchen: Clean and put away dishes ( or hide them). Wipe counters and fixtures.
9. Bathrooms: Wipe counters, fixtures and mirror. Make sure toilets are clean and lids closed. Hang fresh towels neatly. Move toiletries under cabinet or into a closet.
10. Bedrooms: Make bed, put the clothes away in drawers, hide them in the hamper, washer or dryer… 11. Children’s room: Gather toys, games and books, and put them back on bookshelves or in bins.
12. Living room or family room: Remove the clutter; put away books; stash knickknacks and family photos out of sight.
13. Entry way: Hang all coats , hats, umbrellas, keys and bags in a closet- not on the wall hooks. Hide the shoes. Clear away papers and mail.

Do you deed transfer to kids?

Question: I would like to add my daughter's name to the deeds of properties that I own. What is the process and the cost involved in doing this and how should it be worded so that she owns the property free and clear once I am deceased? --D.K. Answer: I Bottom line: In most cases, you are doing a disservice to your children if you put them on title with you. Let me explain. Let's say you bought your home years ago for $100,000 and it is now worth $300,000. If you die today, your daughter will inherit the house and take advantage of the "stepped-up" basis. That means that her tax basis is the value on the date of death, in our example $300,000. Ignoring for this discussion inheritance and estate tax issues, if she sells the property immediately for $300,000, she will have made no gain and thus will not have to pay any capital gains tax. On the other hand, if you gift her half of the house, her basis is yours. Now you die and the property is worth $300,000. Her basis is $50,000 from the gift and $150,000 stepped up from your death for a total of $200,000. If she sells now, she has made a gain of $100,000 and will have to pay capital gains tax. To understand this in simple -- nonlegal -- language, the tax basis of the person who gifts property (giftor) becomes the tax basis of the giftee. If you really want your daughter on title, why not sell her half of the property. Then her basis will be what she paid for it. Talk with your financial advisers for your specific situation.

New 3.8 percent tax on investment income will take effect

Shortly after federal government enacted healthcare reform in 2010, there was considerable concern over a last-minute addition to the legislation: a 3.8% tax on investment income of upper-income households to help shore up Medicare. The tax takes effect on January 2013.

 Passed by Congress in 2010 with the intent of generating an estimated $210 billion to help fund President Barack Obama’s health care and Medicare overhaul plans — could be relevant to your clients.

 Understand that this tax WILL NOT be imposed on all real estate transactions, a common misconception. Rather, when the legislation becomes effective in 2013, it may impose a 3.8% tax on some (but not all) income from interest, dividends, rents (less expenses) and capital gains (less capital losses). The tax will fall only on individuals with an adjusted gross income (AGI) above $200,000 and couples filing a joint return with more than $250,000 AGI.

  Applies to: Individuals with adjusted gross income (AGI) above $200,000 Couples filing a joint return with more than $250,000 AGI
Types of Income: Interest, dividends, rents (less expenses), capital gains (less capital losses)
Formula: The new tax applies to the LESSER of Investment income amount Excess of AGI over the $200,000 or $250,000 amount 

New tax, dedicated to Medicare funding, is imposed on the so-called “earned” income of higher income individuals. Th is earned income tax has a much lower rate of 0.9% (0.009). Like the tax described in this brochure, this additional or alternative tax is based on adjusted gross income thresholds of $200,000 for an individual and $250,000 on a joint return. Like the 3.8% tax, this 0.9% tax is imposed only on the excess of earned income above the threshold amounts.

Another way of thinking about these new taxes is to think of the 3.8% tax as being imposed on a portion of the money that you make on your money — your capital (sometimes referred to as “unearned income”). Th e 0.9% tax is imposed on a portion of the money you make on your labor — your salary, wages, commission and similar income related to earning a livelihood. ★

New Md. laws affecting property tax credits, foreclosures, ground rent

A grab bag of housing-related legislation passed in the Maryland General Assembly's recently completed session. Here are the highlights:

Homestead credit penalties (HB 1081): Authorizes local governments to hit people with bigger penalties if they are found to be receiving a Homestead Property Tax Credit (or credits) they don't qualify for and "willfully misrepresented facts" to get the break. The homestead credit caps big tax increases as a result of property appreciation, but it is only for primary residences.

No homesteads for banks (SB 123): Requires that banks -- or whoever purchases a home at foreclosure auction -- send a copy of the court ratification notice to the state Department of Assessments and Taxation so the new owners don't reap the benefit of homestead tax credits intended for the previous owners. Previously, the assessments agency said it had to wait until the new owner recorded the deed to transfer title, which frequently took months -- even years.

Foreclosed property registry (HB 1373): Requires banks and other owners of foreclosed properties to send ownership and maintenance contact information to a state-run registry so officials and neighbors know who to call if there's a problem.

Pre-foreclosure mediation/expedited foreclosure for vacants (HB 1374): Expands the mediation program for Maryland homeowners behind on their mortgages so borrowers and lenders don't have to wait until the eve of foreclosure for a sit-down meeting if they both agree to it. State officials said they hope earlier intervention will lead to better alternatives than foreclosure. The legislation also allows mortgage servicers to foreclose more quickly on (verified) vacant properties, intended as an anti-blight measure.

Ground-rent registry (HB 177): Requires that owners of ground rent register their property in order to collect payments from homeowners. The law is intended as a replacement for a requirement to register by September 2010 or forever lose the ground rent, struck down by the state's highest court as unconstitutional.

Five mistakes even good homeowners make


Have you ever accidently left a
candle burning unattended? Or left home without turning on the security system? You probably made a mental note to yourself not to do it again but otherwise didn’t think much about it.

But next time, you might not get so lucky. A simple “uh oh” could lead to thousands of dollars in damage to your home.

“It’s a mindset of thinking about the consequences of things, of what could go wrong,” says Tim Reinhold, Ph.D., senior vice president of research and chief engineer for the Institute for Business and Home Safety.

Here are five common safety mistakes that even good homeowners make:

Mistake 1: Not cleaning out the filter on your clothes dryer
Why it’s risky: Fire. Those wads of lint that get caught in your dryer’s filter can pose a major fire hazard. “It’s hot enough, particularly if you’re running the clothes on the dry setting instead of just permanent press,” says Reinhold. According to the Consumer Product Safety Commission, dryers cause more than 15,000 fires annually.

Your strategy: Be sure to completely empty the lint trap every time you use your dryer. Also, make sure that your dryer ducts are metal, since they’re less likely to sag and allow lint to build up.

Mistake 2: Putting cardboard boxes from recent big-ticket purchases out on the curb with the garbage
Why it’s risky: Theft. By placing boxes in a visible location, you’re sending a signal to burglars that you have valuable items in your home.

Your strategy: “Cut those boxes up and put them into the garbage or recycling bin,” recommends ERIE Agent Beverly Goff of Northern Insurance in Fort Wayne, Ind.

Mistake 3: Neglecting tree branches that hang close to your home
Why it’s risky: Roof or other property damage. A snowstorm or even high winds could sweep through your neighborhood and knock those branches right off onto your roof, causing serious damage. Ice can also weigh down branches, causing them to snap off.

Your strategy: Consult an arborist or tree surgeon about any trees in your yard that might present a potential hazard. “You’ve got to think about pruning them back, or if it’s an older tree, having it removed altogether,” says Terry McConnell, ERIE’s vice president and manager, Personal Lines Underwriting.

Mistake 4: Leaving your outside hoses connected to the house during the winter
Why it’s risky: Potential water damage. It’s easy to forget that you never stored your hoses after the weather cooled off. But Goff warns, “Get those hoses disconnected. If you don’t disconnect them, you run the risk of water seeping into the internal walls. Often this type of loss is not detected in a timely manner, causing serious widespread damage, plus the health risk of black mold.”

Your strategy: Disconnect the hoses from the outdoor faucets, roll them up and store them inside your garage or basement before cold weather sets in.

Mistake 5: Not checking the status of the water hoses for your appliances
Why it’s risky: Water damage. Hoses for washers and refrigerators do wear out and need to be replaced before they spring a leak. According to Reinhold, the water supply line to the icemaker can also be a water leak waiting to happen. “The plastic piping on the back of the fridge a lot of times will get brittle with age,” he warned.

Your strategy: Replace washing machine hoses every five years. If you see the plastic line along the back of the refrigerator becoming discolored (yellow or brown), have an appliance repair expert check it out.

Cheap Does Not Always Mean Good

Just because the property is inexpensive doesn’t make it a great investment. If the property does not fit the needs of your target renters, you’ll be unlikely to rent the property continuously and effectively and will likely lose money in the long term on the ‘cheap’ deal.

Empty Equals Lost Money

If your renters turn over quickly, leaving gaps of time the property unrented, you’ll likely not make your investment goals. Check on the rental history of a property before purchase and also examine the amenities around the home including proximity to transportation, shopping and workplaces as well as the quality of the schools. If the property is not in an attractive area, fewer renters will want to live there.

Know Your Costs


When you start investing in real estate, you need to know exactly how much money you can afford for closing costs, fix-up and maintenance, taxes and general holding costs. Be prepared for unexpected repair costs for problem tenants, remodeling that uncover more issues that need fixing, and big-ticket items that may need replacing on short notice. Ensure you have a suitable cushion of cash for these expenses.

It’s Complicated

Owning your own home is one thing. Owning an investment property is completely different. Besides having to adhere to local laws for landlords, you may eventually find it easier to hire a property manager, which could account for around 10%-15% of the monthly rental. If your profit margins are predicted to be thin, you may want to reconsider your investment and keep looking for different property.

What is FHA?

What is FHA?
The National Housing Act of 1934 established the Federal Housing Administration (FHA). In 1965, the FHA becomes part of the US Department of Housing and Urban Development(HUD). Since 1934, the FHA and HUD have insured over 34 million mortgages.

The FHA has also been active in financing the development of multi-family housing. The FHA loan process requires borrowers to have no foreclosures in the past three years and no bankruptcies in the past two years. FHA current down payment requirement is 3.5%. For many years FHA rules require every borrower to put down a minimum of 3.5 present to qualify for a loan. However, this year the organization raised that minimum that amount to 10% for borrowers who had a FICO score (credit score) lower then 580 in order to protect its financial reserves.

What is the limit for the amount of an FHA loan?
It depends on the market of the property being purchased. FHA limits are set on the basis of local area median home price. In low-cost areas, the limit is $271,050, but it could go as high as $729,750 in high cost areas. If you decide to seek an FHA loan there are certain guidelines that Agency loan counselors will want you to meet. Two of the most important are the relative amounts of your mortgage and your household income, and the monthly mortgage payment in relation to your total monthly debt obligations.

Generally, the FHA will want your mortgage payment (generally meaning principal, interest, property taxes and property insurance — PITI) to be no more than 31% of your gross monthly income. Further, your total monthly debt obligation including the mortgage; credit cards; auto loans; student loans; etc. should come to no more than 43% of your monthly income. These ratios are more generous than many that you will find for non-FHA loans being offered today. Even higher ratios are available if you are purchasing an energy-efficient home. The so-called “stretch” ratio is 33/45 — 33 percent for PITI and 45 percent for all ongoing monthly payments. The FHA requires an appraisal of the property. Beyond physical inspection, the applicant must disclose all “sales concessions” to the appraiser. Those may include loan discount points, origination fees, interest rate buy downs, closing cost assistance, payment of condominium fees, builder incentives, down payment assistance or monetary gifts. The FHA has a list of closing costs which it considers reasonable and customary. Those include:

•Lender’s origination fee (one percent maximum)
•Attorney’s fees
•Appraisal fee
•Inspection fee
•Title insurance and title examination fee
•Property survey
•Credit reports (actual cost)
•Transfer taxes and recording fees
